Notice on further protecting minors from electronic cigarettes
On August 28, 2018, the State Administration of market regulation and the State Tobacco Monopoly Bureau issued the announcement on banning the sale of electronic cigarettes to minors (Announcement No. 26, 2018, hereinafter referred to as the announcement). Since the release of the announcement, the awareness of all sectors of the society to protect minors from electronic cigarettes has generally increased, and the phenomena of direct promotion and sale of electronic cigarettes to minors has been reduced. However, it is also found that there are still minors who know, buy and smoke electronic cigarettes through the Internet. Even some e-cigarette enterprises, in order to blindly pursue economic interests, publicize, promote and sell vapes through the Internet, which poses a huge threat to the physical and mental health of minors. In order to further protect minors from electronic cigarettes, the relevant matters are hereby notified as follows:
As the supplement of traditional tobacco products such as cigarette, electronic cigarette has great safety and health risks. It has strong randomness in raw material selection, additive use, process design, quality control and other aspects. Some products have quality safety risks such as e-liquid leakage, poor quality battery and unsafe component addition. In accordance with the relevant provisions of the law of the people’s Republic of China on the protection of minors, and in order to strengthen the protection of the physical and mental health of minors, all kinds of market entities shall not sell electronic cigarettes to minors. Any organization or individual shall dissuade and stop the sale of electronic cigarettes to minors.
At the same time, in order to further strengthen the protection of the physical and mental health of minors and prevent minors from purchasing and smoking electronic cigarettes through the Internet, from the date of the issuance of this announcement, enterprises or individuals engaged in the production and sale of electronic cigarettes are urged to close the Internet sales website or customers in a timely manner; e-commerce platforms are urged to close the vape stores in a timely manner and remove the electronic cigarette products from the shelves in a timely manner; We urge the enterprises or individuals that produce and sell e-cigarettes to withdraw the e-cigarette advertisements published through the Internet.
